1. Acceptance of Terms
By accessing or using the ClearBid platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.
2. User Accounts
You must register for an account to place bids or list vehicles. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration.
3. Auction Rules
All bids placed on ClearBid are binding. Once a bid is placed, it cannot be retracted. The highest bidder at the close of an auction is obligated to complete the purchase. ClearBid reserves the right to cancel any auction or bid at its discretion.
4. Payments & Escrow
All payments are processed through ClearBid's escrow system. Funds are held securely until the transaction is confirmed by both parties. ClearBid charges a commission on completed sales as outlined in our fee schedule.
5. Vehicle Listings
Sellers are responsible for the accuracy of all information provided in their listings. Misrepresentation of a vehicle's condition or history is grounds for account suspension and may result in legal action. All listings are subject to approval by ClearBid administrators.
6. Prohibited Activities
Users may not engage in bid manipulation, shill bidding, fraudulent listings, or any activity that undermines the integrity of the auction process. Violations will result in immediate account termination.
7. Limitation of Liability
ClearBid acts as a marketplace facilitator and is not responsible for the condition of vehicles sold through the platform. All vehicles are sold as-is. ClearBid's liability is limited to the amount of fees paid to ClearBid in connection with the disputed transaction.
8. Changes to Terms
ClearBid reserves the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms. We will notify users of significant changes via email.
